Every year, on 20 June, we celebrate World Refugee Day. The focus this year is on the right to seek safety. Everyone on the planet has the right to seek safety, no matter who they are, where they come from or when they are forced to flee. In 2022, as a result of Russia’s war on Ukraine, Europe is receiving a large new wave of refugees in search of peace and safety.

World Refugee Day: EU solidarity with Ukraine

The EU Temporary Protection Directive enables EU Member States to move rapidly to offer protection and rights to people in need of immediate protection and to avoid overwhelming national asylum systems in cases of mass arrivals of displaced persons. Although invoked several times in the past, the directive has never been activated before. Russia's military aggression prompted a unanimous decision in the Council to grant temporary protection (for an initial period of one year) to people fleeing the war in Ukraine. This temporary protection may be extended automatically by two six-monthly periods, for a maximum of another year. The EU's decision to grant temporary protection has been widely welcomed and the directive is considered the most appropriate instrument under the current exceptional circumstances. There are, however, still many open questions as to its practical implementation in the EU Member States.

International law imposes an obligation to render assistance to persons and ships in distress at sea, which must be provided regardless of the persons' nationality or status or the circumstances in which they are found. Nevertheless, over the last couple of years, the Mediterranean Sea has been the backdrop for the largest number of casualties and missing people. One solution, proposed by academics, could be the harmonisation of the fragmented legal regime for maritime interceptions.

EP President Metsola made&nbsp;a statement at the opening of the February session, followed by a full debate on the emergency humanitarian aid the EU can provide to Türkiye and Syria after the catastrophic earthquake, which cost the lives of more than 30 000&nbsp;people and destroyed tens of thousands of buildings, leaving hundreds of thousands homeless.

Turkey has been candidate for EU membership since 1999. Accession negotiations started in 2005. In recent years the EU is often criticizing the backsliding of the country in certain areas. As a major emerging economy and a member of NATO and G20, Türkiye&nbsp;is recognised as an active regional foreign policy player, with a strategic location, including for the EU's energy security. Turkey is a key strategic partner of the EU on issues such as migration, security, counter-terrorism, and the economy, but according to the EU has been backsliding in the areas of democracy, rule of law and fundamental right.

EU - Türkiye

The European Parliament in April 2024 adopted ten legislative texts to reform European migration and asylum policy as agreed with EU member states. Five separate EU regulations, establishe&nbsp;how to share the management of asylum and migration flows among member states and what to do in cases of sudden migratory crisis.

The rules also regulate how to deal with people arriving at the EU’s external borders, the processing of asylum claims, and the identification of those arriving.

Following the deal in trilogue in December 2023 ,&nbsp;EP President Roberta Metsola&nbsp;said: “”Today is a truly historic day, as we have delivered on the Migration and Asylum Pact, possibly the most important legislative package of this mandate. Europe will now get a robust legislative framework that is the same in all Member States. That functions and that protects, an approach that is humane and fair with those seeking protection, that is firm with those who are not eligible, and that is strong with those who exploit the most vulnerable &nbsp;

Refugee movements and migration are at the centre of global attention.&nbsp; The European Parliament is actively involved, in the adoption of new laws on irregular and regular immigration. It is a full co-legislator together with the Council representing member states on these matters since the entry into force of the Lisbon Treaty in 2009.

Migration

Europe is faced with a significant influx of migrants: hundreds of thousands of people fleeing from war and poverty are travelling to Europe in search of safety and a better life. 

The increase in migration to Europe requires a response from the EU on a number of levels. Firstly, policies to handle regular and irregular immigration, and secondly, common EU-wide rules on asylum. The migrant crisis of late has also resulted in a need for additional measures and reforms to ensure border security as well as a fairer distribution of asylum seekers among EU countries.

Migration - 8th Parliamentary term

The number of international migrants worldwide has continued to grow rapidly in recent years, reaching 258 million in 2017, up from 220 million in 2010 and 173 million in 2000.

Refugee movements and migration are at the centre of global attention. In recent years, Europe has had to respond to the most severe migratory challenge since the end of the Second World War. The unprecedented arrival of refugees and irregular migrants in the EU, which peaked in 2015, exposed a series of deficiencies and gaps in EU policies on asylum, external borders and migration.

Migration (2020)

On 1 and 2 October, EU leaders meet in Brussels to discuss foreign affairs, in particular relations with Turkey and the situation in the Eastern Mediterranean.

The leaders are also expected to address relations with China, the situation in Belarus and the poisoning of Alexei Navalny. The single market, industrial policy and digital transformation are also on the agenda

The summit, initially planned for 24 and 25 September, has been postponed as President Michel is in quarantine.

Special European Council, 1-2 October 2020

Turkey has been candidate for EU membership since 1999. Accession negotiations started in 2005.

As a major emerging economy and a member of NATO and G20, Turkey is a key partner for the European Union. It is recognised as an active regional foreign policy player, with a strategic location, including for the EU's energy security. The EU is therefore committed to intensify further the political dialogue with Turkey in particular on foreign policy issues of mutual interest.

EU - Turkey (2019-2020)

EU leaders met in Brussels for a two-day summit. On 24 June they discussed COVID-19, migration and external relations, including Turkey and Russia. They also met UN Secretary-General António Guterres. In the evening, they discussed the EU fundamental value of LGBTIQ non-discrimination. On 25 June economic recovery and the challenges for the euro area were on the agenda.

The European Council welcomed the good progress on vaccination and the overall improvement in the epidemiological situation. The leaders also stressed the need to continue vaccination efforts, be vigilant and coordinated, particularly in developments such as the emergence and spread of variants of concern. EU leaders also acknowledged the importance of the agreements reached on the EU digital COVID certificate and on the revision of the two Council recommendations on travel within the EU and non-essential travel into the EU. EU countries are to apply them in a manner that will help achieve the full return to free movement as soon as the public health situation allows.

The European Council discussed the migration situation on the various routes. While the measures taken by the EU and its member states have brought down the overall irregular flows in recent years, developments on some routes give rise to concern and require continued vigilance and urgent action. EU leaders agreed that mutually beneficial partnerships and cooperation with countries of origin and transit will be intensified to prevent loss of life and to reduce pressure on European borders, as part of the EU's external action.

Leaders also reviewed the state of play on the implementation of the EU's Next Generation EU recovery plan. They underlined the importance of full and timely implementation of the national recovery and resilience plans while protecting the financial interest of the EU. They encouraged the Commission and the Council to take the work on the plans' approval forward to enable member states to use the recovery funding to its full potential.

The refugee and migrant crisis in Europe has exposed the need for reform of the Common European Asylum System, in general, and of the Dublin rules, in particular.

Parliament’s lead MEP on the reform of the Dublin system, Swedish liberal Cecilia Wikström, presented her draft report to the Civil Liberties Committee in October 2017. The draft report, approved by the Plenary of the Parliament in November 2017, is a first response to the Commission’s proposal, presented in May 2016, for reform of the Dublin regulation. This regulation, which determines which member state is responsible for processing an asylum application, constitutes the cornerstone of the EU asylum system, which is currently undergoing a major revamp.

The European Parliament is therefore ready to start talks on revamping the Dublin system to ensure that asylum seekers are fairly shared among EU member states.

On 12 September 2018, the Commission came forward with a proposal for a new regulation on the European Border and Coast Guard as part of initiatives aiming to develop long-term migration policy. The proposal aims to reinforce the protection of the European Union external borders and to increase the efficiency of returning migrants in an irregular situation.

During the last Plenary session of its mandate the European Parliament approved the new law to strengthen the European Border and Coast Guard, to ensure better protection of EU external borders.

A new standing corps will be set up to support EU countries on the ground in border control and return tasks, as well as in the fight against cross-border crime. Starting with 5,000 operational staff in 2021, the standing corps will be fully operational by 2027 with 10,000 staff. In addition, a rapid reserve pool will be created for deployment in emergencies.

Managing migration in an effective and holistic way through fostering returns

MEPs delve into the management of Europe’s external borders and the role of the EU Border and Coast Guard Agency.  
Migratory pressures towards Europe are expected to increase and cross border-crime will continue to evolve in the context of geopolitical instabilities in the EU’s neighbourhood, requiring enhanced border management. Commission President Ursula von der Leyen told Parliament in July that Frontex could further increase its staff to 30 000 agents. MEPs quiz the Commission on technological solutions and possible changes to Frontex’s mandate. They are also likely to raise the issue of the instrumentalisation of migrants by third countries as well as fundamental rights violations at the EU’s borders.

MEPs discuss and vote on Wednesday on ten new bills updating the EU asylum and migration rules, emphasising cooperation and mandatory but flexible solidarity. 

Plenary wraps up this term’s legislative work in the field of migration and asylum with a debate with the Belgian Council Presidency and the Commission on the outcome of negotiations over the Migration and Asylum Pact. The already agreed texts aim to improve cooperation among European states and enhance the EU’s response in case of crises. 

The Pact encompasses a new framework for a comprehensive asylum and migration policy based on solidarity, fair responsibility sharing, and updated rules on criteria and mechanisms to determine the member state responsible for examining an application for international protection (formerly known as the Dublin rules). Member states will be able to choose between relocating asylum applicants to their territory, making financial contributions or providing operational and technical support to member states under migratory pressure. 

There will be specific rules for crisis situations, and the rules on reception standards for asylum applicants will be updated. The amended qualification rules will set uniform standards across the EU to recognise people applying for international protection, as well as their rights. There will be a faster common procedure –including provisions on inadmissible claims and more expedited returns- across the EU to grant and to withdraw international protection, following an initial pre-entry screening and registration of fingerprints and facial images in a common database (Eurodac). Finally, a new EU framework for resettlement will regulate the opportunities for refugees in third countries to come to the EU, based on member states’ voluntary participation
