In March 2018, the EU introduced a legislative package on the fair taxation of the digital economy. It contained proposals for an interim and a long-term digital tax. However, there was no immediate political agreement in the Council. As finding a global solution at the OECD level or a coordinated EU approach was not yet feasible at the time, some Member States started designing or implementing their own digital taxes, which gave rise to trade tensions. After a series of special committees and a committee of inquiry, created to delve into the various tax leaks and scandals of recent years, Parliament established a more permanent setup to shed light on the matter.

The Economic and Monetary Affairs (ECON) subcommittee on tax matters, FISC, will be composed of 30 members. It will deal particularly with the fight against tax fraud, tax evasion and tax avoidance, as well as financial transparency for taxation purposes.

The constituent meeting will take place on Wednesday, 23 September 2020.

FISC - Subcommittee on Tax Matters

Tax measures must be adopted unanimously by the Member States. The European Parliament has the right to be consulted on tax matters, except on budgetary-related issues, for which it is co-legislator.

The power to tax is in the hands of the Member States, with the EU having only limited EU competences. As EU tax policy is geared towards the smooth running of the single market, the harmonisation of indirect taxation was addressed before direct taxation. The fight against harmful tax evasion and tax avoidance has become a recent policy priority.

Fight against tax fraud and evasion - 8th parliamentary term

Tax policy, including the fight against tax fraud, has become a hot topic over the past decade due to journalistic investigations such as LuxLeaks, the Panama Papers, Football Leaks, Bahamas Leaks and the Paradise Papers, which revealed tax leaks and tax havens. The latest finacial data-leak revealed by the media is Pandora papers.

During October II plenary MEPs voted for a resolution on Pandora papers, where they identified what they see as the most urgent measures the EU needs to take to close loopholes that currently allow for tax avoidance, money laundering and tax evasion on a massive scale. They also called for legal action to be taken by the Commission against EU countries that do not properly execute existing laws. MEPs reserved particular criticism for present and former prime ministers and ministers of EU member states whose activities were revealed by the Pandora Papers.

Tax policy has remained EU countries' own responsibility since the EU’s beginning, but the fight against tax fraud is shared by EU countries and the EU.

In November MEPs gave their final green light to new rules obliging big multinationals to publicly declare the taxes they pay in each EU country, in order to undermine tax avoidance. Multinationals and their subsidiaries with annual revenues over €750 million - and which are active in more than one EU country - will now have to publish the amount of tax they pay in each member state. This information will also need to be made publically available on the internet, using a common template and in a machine-readable format.

Since September 2020, the Parliament has had a permanent sub-committee on tax matters. The committee was established to assist the economic and monetary affairs committee with taxation issues and deals with the fight against tax fraud, tax evasion and tax avoidance, as well as financial transparency in taxation.

Fight against tax avoidance

Tax avoidance by companies cost EU countries €160-190 billion per year in lost revenue.

According to a Eurobarometer survey commissioned by the European Parliament, 75% of the EU population expects more EU action on the fight against tax fraud: it is necessary to respond effectively to this concern.
The European Parliament is leading this fight by adopting ambitious and concrete proposals to increase tax transparency and combat tax avoidance. Parliament is calling for the automatic exchange of tax rulings between member states and public country-by-country reporting for multinationals, together with a common definition of tax havens and strong and concrete sanctions.

Following continued revelations in the last 5 years (Luxleaks, the Panama Papers, Football leaks and the Paradise Papers), the European Parliament decided to establish a Special Committee on Financial Crimes, Tax Evasion and Tax Avoidance (TAX3), on 1 March 2018.

The work of the TAX3 Committee built on the work of its predecessors (the TAXE, TAX2 and PANA Committees) and investigated new issues, such as digital taxation, national citizenship programs and VAT fraud.
In the course of its mandate, the TAX3 Committee met 34 times and organized 4 fact-finding missions to Washington, Latvia, the Isle of Man, Estonia and Denmark. Hundreds of experts were heard, including Commissioners, Ministers, prosecutors, investigative journalists, anti-money laundering and tax experts, accountants, bankers and NGO representatives before submitting a final report with its recommendations, including a detailed roadmap towards fairer and more effective taxation, and tackling financial crimes.

This infoclip aims to illustrate the inclusion or non-inclusion of gas and nuclear in the list of environmentally sustainable activities covered by the EU taxonomy. The complementary Taxonomy Delegated Act put forward by the Commission on 9 March 2022 proposes the inclusion of specific nuclear and gas energy activities in the list of environmentally sustainable economic activities covered by the EU taxonomy. The Taxonomy regulation is part of the Commission’s action plan on financing sustainable growth and aims to boost green investments. The footage shows the arrival of Liquefied natural gas (LNG) in Rotterdam, The Netherlands, household gas consumption in Belgium, and a nuclear plant in Forsmark, Sweden.

The joint ECON and ENVI Committees hold a vote on a motion for resolution objecting to the Complementary Climate Delegated Act (CDA) under the Taxonomy Regulation, adopted by the Commission on 9 March 2022. Bas EICKHOUT (Greens/EFA, NL) explains the Parliament's position. The vote is adopted 76 in favour, 62 against and 4 abstentions. The resolution will next be voted in the July plenary where an absolute majority will be required.
